Moonchild Creative Website Terms and Conditions

1. General Terms

  • These terms and conditions govern the use of services provided by Moonchild Creative, including wedding and event coordination services and the use of Casa Luna Content Studio.
  • By engaging with our services or using our studio, you agree to comply with and be bound by these terms.
  • These terms are in accordance with Australian and South Australian laws and regulations.

2. Deposits for Weddings and Events

    • A non-refundable deposit of 30% is required to secure the booking for weddings or events. This deposit is essential to confirm your booking and secure the date.
    • The full payment is required 30 days before the event date, unless otherwise agreed upon in writing.
    • Cancellations must be made in writing. The cancellation policy is as follows:
      • If the cancellation occurs more than 30 days before the event and more than 6 months after the initial booking was made, a full refund of payments made will be issued, excluding the deposit and the cost of any services already completed.
      • If the cancellation occurs less than 30 days before the event, there will generally be no refund or up to a 25% refund (excluding the deposit). This will be assessed on a case-by-case basis, taking into account the work completed, loss of work and opportunity, wages, bookings, stock paid for, and other related factors.
  • Any changes to the booking date or event details may incur additional fees and are subject to availability.

3. Casa Luna Content Studio Use

  • Booking of the Casa Luna Content Studio is subject to availability and must be paid in full via our bookings system for a confirmed session.
  • Cancellations of studio bookings must be made in writing.
      • If cancellation occurs more than 14 days before the booking date a full refund may occur minus $50 administrative and processing fee. 
      • If cancellation occurs less than 14 days before the booking date: no refund is eligible. 
    • No refunds are available after studio session use has occured. 
  • Users of the studio are responsible for any damages caused to the property or equipment during their booking and will be charged for repair or replacement costs.
  • All users must comply with safety regulations and instructions provided by Moonchild Creative staff.

4. Council Considerations for City of Charles Sturt

  • The Casa Luna Content Studio is located on Port Road, Allenby Gardens, within the jurisdiction of the City of Charles Sturt.
  • There is no parking allowed in front of the studio between 3:00 PM and 7:00 PM as per council regulations. Users must adhere to this restriction to avoid penalties.
  • No rear access parking is available for studio users. This area is reserved for other owners within the complex. Any vehicles parked in unauthorised areas may be towed at the owner's expense.
  • Users are responsible for ensuring that all activities comply with local council regulations, including but not limited to noise levels and waste disposal.

5. Website Usage

  • The Moonchild Creative website is intended for informational purposes and to capture electronic payment. By using this website, you agree to our terms of use and privacy policy.
  • Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence under Australian law.
  • Moonchild Creative reserves the right to update or modify these terms at any time without prior notice. It is the user's responsibility to review the terms periodically.

6. Liability and Indemnity

  • Moonchild Creative is not liable for any indirect, incidental, or consequential damages arising from the use of its services or facilities, including but not limited to loss of profit, data, or business opportunities.
  • Users agree to indemnify and hold Moonchild Creative harmless from any claims, damages, losses, liabilities, and expenses arising from or related to their use of the services or facilities.

7. Compliance with Laws

  • Users of Moonchild Creative services and facilities must comply with all applicable Australian and South Australian laws, including local council regulations.
  • Any breach of these terms and conditions may result in termination of services and/or legal action.

8. Governing Law

  • These terms and conditions are governed by the laws of South Australia. Any disputes arising from these terms will be subject to the jurisdiction of the courts of South Australia.
